Texas Indictment Against Pete Fulcher for Aiding Butch Cassidy and the Wild Bunch

2pp partly printed, measuring 8.5" x 14", Callahan County, Texas, dated May 16, 1903. A Grand Jury indictment, No. 1206, against Pete Fulcher for Accessory for Robbery, stating that he "unlawfully and wilfully [sic] conceal and give aid to the said O.C. Hanks and George Parlor, alias Frank Nixon, alias Butch Cassady" for an assault and robbery on C.H. Smith on July 3, 1901. Approximately $50.00 was believed to be stolen, although the document states that the true amount is unknown. The two-page indictment contains both typewritten and handwritten text and is signed by the foreman of the Grand Jury, J. H. Breeding. With flattened folds and light soiling throughout. A few small separations and minor paper loss have occurred at some folds, not affecting the text. The two pages have been stapled together, overall very good.

This indictment refers specifically to the last heist of the notorious Wild Bunch, conducted by members Harvey "Kid Curry" Logan, Ben "Tall Texan" Kilpatrick, and Orlando Camilla "Deaf Charley" Hanks, who had just been released from Deer Lodge, Montana penitentiary on May 30, 1901. Hanks reunited with the remaining members of the Wild Bunch and on July 3, 1901, they robbed the Great Northern Coast Flyer No. 3 near Wagner, MT. The three men stole a large number of banknotes intended for the National Bank of Montana. At the time of the robbery, it was widely believed that the leader of the Wild Bunch, Butch Cassidy, was involved in the robbery and he was included on the warrant released by the Pinkerton detectives. Cassidy, however, was already in South America, having departed with the Sundance Kid on February 20, 1901.

The three robbers involved went on the run: Hanks fled to his home state of Texas, where he presumably received aid from Pete Fulcher, indicted here. Hanks continued to San Antonio where he would meet his demise at the hands of authorities in April 1902 while resisting arrest. Butch Cassidy (born Robert LeRoy Parker) went by many aliases during his career including George Parker. The indictment here lists "George Parlor, alias Frank Nixon, alias Butch Cassidy," perhaps adding to his list of pseudonyms. Though it is also possible that the court was just misinformed as it was impossible that Butch Cassidy was ever involved in the heist.
