Portion of a legal document inscribed entirely in the hand of Supreme Court Justice Roger B. Taney (1777-1864), and signed by him at upper left as "Roger Brooke Taney." Undated, though likely 1801-1816. Lacks the bottom portion of document. Expected light folds and isolated closed tears, else near fine, 8" x 6.25". Docketed verso. Accompanied by an Art Craft print of Key with a quote and facsimile signature.

 

The document pertained to a court case lodged by Taney and two other co-plaintiffs, his brother-in-law and "Star Spangled Banner" poet Francis Scott Key, and one Arthur Shaaff, member of an influential Maryland family. The trio brought charges of trespassing and theft against two defendants, John Hosselbach and Thomas Chisholm, each of whom were accused of illegally removing $20,000 worth of oak, locust, and chestnut trees from private property. It is likely that the three plaintiffs were neighbors.

Roger B. Taney, who served as Chief Justice of the U.S. Supreme Court between 1836-1864, had married Francis Scott Key's sister Anne Key (1783-1855) in 1806. In addition, Taney shared a law practice with Key in Frederick, Maryland.
