3pp ADS signed by Declaration signer George Ross (1730-1779) as "Ross" in bottom left corner of third page. Docket information appears on the last page. In very good condition, with beautiful, bold, and dark calligraphy. Even overall toning. Paper folds are fragile, and some have been repaired and are currently detached. Each page measures 8.375" x 13.125".

 

Judges, lawyers, and jurors summoned to deliberate on civil and criminal cases in the December Term of 1759 in Philadelphia County, Pennsylvania would have adjudicated the case of Hassert vs. Everly. Yeoman Arent Hassert accused one John Everly of trespassing, yet a 12-man jury found Everly innocent of all wrongdoing and even awarded him "Forty pounds lawfull money of Pennsylva".

 

Arent Hassert had prepared a Bill of Indictment to bolster his spurious claim that John Everly did "Evilly tread". Everly pleaded that he was a "fine & honest Subject of our Lord then now King, & of good name & Credit among his neighbors, & other faithfull subjects." He maintained his innocence throughout the case, spending sums of money to clear his name, and overall "put[ting] himself upon the Country" for their decision. Ultimately, jurors like Thomas Shoemaker, Martin Ashburne, and Richard Wood determined that Arent Hassert's accusations were false and prompted by "mere malice". Ross approved of the court's decision by signing this document.

 

George Ross entered the Pennsylvania bar in 1750. Initially the young lawyer had Tory sympathies, but he radicalized sometime during the transition from private practice to his 12-year tenure as Crown Prosecutor of modern day Cumberland County, Pennsylvania. Ross was one of nine Pennsylvania delegates to sign the Declaration of Independence. He was elected to three Continental Congresses, and served as a Colonel in the Continental Army. He died at age 49.
