Fine content autograph document signed "Jas. Jackson", two pages, 9" x 12.25", [n.p. but probably Georgia], [n.d. but docketed "1777" at top in pencil]. Titled "The Governor requests my opinion on the fifty-second article of the Constitution." Conserved with archival tape at middle fold, light wear to edges and usual signs of age, otherwise boldly penned and in very good condition.

Jackson writes, in part: "…Our Constitution by that article and our Legislature by their explanation in the Superior Court Law have in my opinion changed the System or form but have not done away with the foundation. Of course the Ordinary or his power is still existing and where that power is lodged applications on all matters tending to that branch ought to be had - Our Constitution says a Register of probates shall be appointed in every County for proving wills and granting letters of administration. Our Superior Court Law says where either of those are contested, the Chief Justice & his associates shall be the Judges. This formerly was the business of the Ordinary and therefore the Register with the Judges are now that State Ordinary.

The matter next for consideration is this[:] Is or is not the Granting Letters of Guardianship which likewise within the verge [?] of Ordinary authority. It most assuredly was formerly & in my opinion not done away, therefore lodged at present with the Ordinary in Office which I look on to be the Register & Judges. Tho I think justly the Governor for the time being the most proper person. I might however enlarge that opinion by saying it would be better for the State was the Ordinary business as formerly in the Governor's hands. We have taken it from him, incr3eased but this be the call until our Constitution wears another face…".

James Jackson (1757-1806) was an early Georgia politician -- a congressman and senator for that state and later its governor. Jackson is remembered for overturning the Yazoo Land Fraud of 1795, ensuring the Jeffersonian party's domination of Georgia politics for the next generation.

All items will ship with a signature required option, and full insurance. Most items are sent via Federal Express, with P. O. Box addresses being sent through USPS. We insure through Berkley Asset Protection with rates of $.70 per $100 of value, among the lowest insurance rates in the industry. Our shipping department cameras document every package, both outgoing and incoming, for maximum security. In addition, we compare our shipping and handling rates against those of other auction houses, to ensure that our charges are among the lowest in the trade.

Upon winning your item(s), you will receive an invoice with our in-house shipping and handling fees included. ***We will ship to the address as it appears on your invoice. If any changes to the shipping address need to be made, you must inform us immediately.***

International shipments: In order to comply with our insurance provider, all international shipments will be sent via Fed Ex and customs paperwork will show a value of $1.00. International buyers should contact our office directly with any questions regarding this policy.

Third-Party Shipping Option: If a third-party shipper is preferred, the buyer is responsible for contacting them directly to make shipping arrangements. For your convenience, we have provided some recommended shippers. At that point, our responsibility and insurance coverage for your item(s) ceases. Items picked up by third-party shippers are required to pay Connecticut sales tax.
