Key Francis 1779 - 1843 Beautiful, exhibitable Francis Scott Key ALS as a lawyer complaining about a case lost "not on the merits" vows to "remove the case to the Supreme Court"

Autograph Letter Signed "F S Key," 1 page, 8" x 9.75". G.T. [Georgetown, D.C.], October 4, 1830. Integral leaf addressed by Key to "Mr. Alexr M. Peltz / Sheriff's Office / Philadelphia," postmarked "GEORGET N. DC OCT 5." Partially separated at folds. Fine condition.

In part, "Your cause was decided against us in the Circuit Court - not on the merits, but on a question of law incidentally arising in the case. - I took an exception to the Court's opinion & intended to remove the case to the Supreme Court - But a proposition was made by Clarke's counsel for a compromise, & I thought we might come to terms. I wished to avoid the expence of the appeal and any further litigation, & I have from time been encouraged by Clarke's Counsel assisting me they would advise their Client to agree to what I proposed. But they have either been unable to overcome his obstinacy, or else have neglected it -- He has two Lawyers both of whom horrified me to advise him - He would see one, & then he waited to see the other..."
