William Livingston, then NJ Governor and Future Constitution Signer, ADS

 

1p ADS inscribed overall and signed by then New Jersey Governor and future Constitution signer William Livingston (1723-1790) as "Wil: Livingston" at bottom of first page. Written in Elizabeth, New Jersey on August 13, 1785. Cream watermarked bifold paper docketed on the fourth page. In very good to near fine condition, with expected folds, chipped edges, and a few holes not affecting text. Isolated stains mentioned just for accuracy. Each page measures 7.625" x 9.125."

 

The document reappointed William Burnet (1730-1791) Judge of the Court of Common Pleas for Essex County, New Jersey. This county located in the northeastern corner of New Jersey contained major cities Newark and Orange.

 

With original spelling:

 

"To all to whom these Presents shall come Greeting

 

This is to Certify that William Burnet Eqr. whose name is subscribed to the acknowledgment indorsed on the instrument of writing hereunto anexed is the first Judge of the Court of Common Pleas in and for the County of Essex in this State duly appointed according to Law and that to such his attestations full faith and Credit ought to be given

 

In testimony whereof I have here unto Set my hand and Caused the Great Seal of the State to be affixed at Elizabeth Town this thirteenth day of Augs. in the year of Our Lord one thousand Seven hundred and Eight five

William Livingston served as Governor of New Jersey between 1776-1790. The Yale graduate was a trained lawyer and took an eager interest in colonial politics and the press. During the Revolutionary War, Livingston served as a New Jersey delegate to the Continental Congress and also as a commander of the state militia. In 1787, just two years after signing this judicial appointment, Livingston would attend the Constitutional Convention in Philadelphia and sign the Constitution.

 

William Burnet was a contemporary of Livingston's with a similar educational, professional, and political background. After graduating from Princeton, Burnet trained as a doctor in New York City. In the American Revolution, Burnet supervised the creation of a Newark military hospital in his capacity as Surgeon General of the Eastern District of the Continental Army. He was also a New Jersey delegate to the Continental Congress. Burnet served as Judge of Essex County between 1776-1786. His wartime duties on the bench included trying and prosecuting Loyalists aiding the British.
