Supreme Court Justice John McLean Urges Sec of the Navy Abel Upshur to Recommend to President John Tyler the Appointment of a Midshipman


Autograph Letter Signed “John McLean” as Associate Justice of the Supreme Court, 1p, 8” x 10”. Cincinnati, April 25, 1842. To Secretary of the Navy Abel Upshur. Endorsements on verso of N.C. Read, Justice of the Ohio Supreme Court, and Geo. P. Torrence, Judge of the 9th Judicial District of Ohio with a note identifying Read and Torrence by Ohio Whig Congressman Nathanael G. Pendleton. Light show through, minor flaws on verso. Fine condition.



In full, “Mr. Gore of this City informs me that his son Daniel Gore Jun. has been recommended for the appointment of Midshipman in the Navy. This youth I understand is promising and well educated for his years. Mr. Gore, the father, constitutes one of a family, which was among the first settlers in this country and is of great respectability and influences. This appointment would be gratifying to a large circle of friends and among others.”



John McLean served as Postmaster General in the Cabinets of James Monroe and John Quincy Adams from 1823 until 1829 when Adams appointed McLean Associate Justice of the Supreme Court (1829-1861). In 1848, he sought the Whig nomination for President and in 1856 finished second in the balloting for the Republican nomination. He also received votes at the 1860 Republican Convention which nominated Lincoln. In the Dred Scott decision, he was one of two dissenting Justices to the majority vote.



The recipient of this letter, Secretary of the Navy Abel Upshur, on February 28, 1844, joining President John Tyler and many other dignitaries for a Potomac River cruise on the new steamship USS “Princeton,” was killed with several others when one of the ship's guns exploded.
