Typed document signed "Stanley Reed", 6pp, 4to, being an excerpt of the Court's opinion of Morgan vs. Virginia. In part: "...Irene Morgan, a Negro passenger on a bus operating between Virginia and Maryland, refused to change her seat upon the order of the bus driver, who by Virginia statute was under a duty to see that segregation was maintained...Mr. Justice Reed deliverd the opinion of the Court...this statute so burdens interstate commerce...the requirements of national uniformity as to be invalid....As no state law can reach beyond its border...the need for national uniformity in the regulations for interstate travel...Reversed." This case was one of the first to end lawful segregation. Upon Morgan's conviction and an affimation by the Virginia Supreme Court, she appealed to the United States Supreme Court. Thurgood Marshall, who was Morgan's lawyer, argued that since the bus was traveling between Virginia and Maryland and Maryland did not have segregation, Morgan was not required to change her seat. The court decided in favor of Morgan, concluding that uniform laws must exist for interstate commerce and effectively outlawed segregation on interstate passenger carriers. The case foreshadowed the Montgomery Bus Boycott and Brown vs. Board of Education, where Marshall argued before the Supreme Court that segregation was unconstitutional. Very fine.
