Rutherford Hayes Signs a Warrant for a Fugitive for the Crime of Murder

 

Single page document signed, 13" x 17." Dated "April 20, 1868," and signed by Rutherford B. Hayes as "RB Hayes," Governor of Ohio, and cosigned by John Russell as Secretary of State. Rounded saw tooth State of Ohio seal affixed to the lower left corner of the document. Light toning with expected folds. Professionally restored to small separations along fold lines.

 

Rutherford Hayes signs a warrant for the arrest and surrender of the body of Barney alias "Barrett Mc Daniel," a "fugitive from the justice of said State of South Carolina charged with the crime of Murder." The warrant was an attempt to apprehend said Barrett and deliver him to the agent appointed by the State of South Carolina to be tried for the crime charged. In the Newspaper records from that period, it appears that Barrett Mc Daniel, along with James Stephens, privates Co.D, 40th infantry, black, were tried by Military commission and convicted of murder, with this being perhaps the precursor warrant to locate Barrett in order to bring him to trial.

 

It would be eight years later that Rutherford Hayes would be elected president in one of the most contentious elections in national history. He lost the popular vote to a Democrat but he won an intensely disputed electoral college vote after a Congressional commission awarded him twenty contested electoral votes. The result was the Compromise of 1877, in which the Democrats acquiesced to Hayes's election and Hayes withdrew remaining U.S. troops protecting Republican office holders in the South.
