Roger Sherman Commands CT Defendant to Report to New Haven

 

1p document in secretarial script signed by Declaration Signer Roger Sherman (1721–1793) as "Roger Sherman Assise" at lower right. Signed at New Haven, Connecticut on October 27, 1788. The cream laid paper is affixed to a slight larger heavy stock sheet. With several partial separations along intersecting folds, two folds through single letters of signature, scattered light toning, and paper loss to lower right corner. Damage to the "e" of "Roger" and "er" of "Sherman". Else in very good condition. 7.875" x 6.375".

 

Sherman, then on the Governor Council of the Connecticut Assembly, orders the sheriff of Litchfield County, Connecticut or the Constables of Watertown to bring defendant Asa Leavenworth (ca. 1743-1828) to court.

 

In part, with unchanged spelling and punctuation:

 

“To the Sheriff of the County of Litchfield his Deputy or either of the Constables of the Town of Watertown within said County Greeting–In the Name of the Governor and Company of the State of Connecticut you are hereby commanded to Summons Asa Leavenworth of said Watertown to appear before the County Court to be holden at New Haven within and for the County of New Haven on the second Tuesday of November next, then and there to answer unto David Warner of Waterbury in said New Haven County. In a plea of the Case whereupon the Plaintiff declares and says that the Defendant…Promised the Plaintiff for value received to pay him the Sum of four Pounds Silver moneys worth of Neet Cattle...”
