Newton Earp Twice-Signed Subpoena Dated in 1883 While Serving as a Constable in Kansas with Original Tag from the Tombstone Western Heritage Museum

Newton Jasper Earp (1837-1928) twice signed partially printed subpoena. Both sides of a single sheet, 3.5" x 8.5"; Ford County, Kansas; October 15, 1883. Earp engrosses the verso of a subpoena commanding C.J. Jones to appear in court to testify in the case of Zelpha Handy v. John Stevens on behalf of the defendant. Earp writes that he received the subpoena on October 15, 1883 and read it to Jones, signing "N.J. Earp." He signs a second time listing his fee of $25. Smoothed folds, and stray ink smears affecting some text of the subpoena. A great association to his more famous half-brother, Wyatt Earp.

Newton Jasper Earp was the eldest born to Nicholas Porter Earp and his first wife, Abigail. Wyatt, Virgil, Morgan, and Warren were children of Nicholas' second marriage. Newton served in the Civil War and settled in the Midwest, living in Kansas until the mid-1880s. He led a quiet life by contrast to his more notorious half-brothers Wyatt, Virgil, and Morgan who took part in the famous confrontation with the Clantons and McLaurys at the O.K. Corral on October 26, 1881.

By 1883, Wyatt had left Arizona after Morgan's assassination. That year he was essentially a Western drifter, gambler, and sometimes lawman, moving frequently between boomtowns. Both brothers would end up in California by the late 1880s. Newton settling in San Bernardino County, and Wyatt in San Diego, during a real estate and gambling boom.

We insure through Berkley Asset Protection with rates of $.70 per $100 of value, among the lowest insurance rates in the industry. Our shipping department cameras document every package, both outgoing and incoming, for maximum security. In addition, we compare our shipping and handling rates against those of other auction houses, to ensure that our charges are among the lowest in the trade.

Upon winning your item(s), you will receive an invoice with our in-house shipping and handling fees included. ***We will ship to the address as it appears on your invoice. If any changes to the shipping address need to be made, you must inform us immediately.***

International shipments: In order to comply with our insurance provider, all international shipments will be sent via Fed Ex and customs paperwork will show a value of $1.00. International buyers should contact our office directly with any questions regarding this policy.

At that point, our responsibility and insurance coverage for your item(s) ceases. Items picked up by third-party shippers are required to pay Connecticut sales tax.
