Letter from New Orleans During War of 1812 Mentions Captured Ship and Pending Litigation

 

“they could not commence a suit against him in this District he being in Mississippi Territory, and if it were brought on there, you could not obtain Justice”

 

This letter advises Captain Daniel Fisher that he could not sue Mr. Livingston in Louisiana and that it was doubtful he could successfully sue him in Mississippi Territory.

New Orleans 16th Novr 1813

Capt Daniel Fisher

Sir

            I would have wrote you on my arrival but been Inform’d of Mr Livingston’s departure for York, I deem’d it unnecessary as Mr Deversac his agent was to write you p post and could give you every information

            Messrs Porter & Depyster inform’d me that they answer’d all your letters p Mail and that they could not commence a suit against him in this District he being in Mississippi Territory, and if it were brought on there, you could not obtain Justice, however the papers are in possession of Mr Deversac the agent of Mr Livingston who I presume have wrote you the particulars. I arriv’d here on the 23rd of Octr after a passage of 28 days and saw no obstruction of any note. We shall sail on the 1st of next month with the Ship Jane under our convoy which is the only delay we have, with the exception of a few Hands, which I make no doubt we can procure by the time of our departure.

Historical Background

After the United States declared war on Great Britain in June 1812, Congress authorized the president to issue letters of marque to private armed schooners so they would prey on British shipping. The United States issued six letters of marque and general reprisal in United States. Stephen Debon secured one of them for his armed schooner Spy, which captured the ship Jane of Greenock, Scotland, in January 1813. The Jane, a “handsome new ship” with a cargo of mahogany and logwood, twelve guns, and twelve men. On February 1, an American district judge condemned the ship and cargo as “good and lawful prize.”

 

Benjamin P. Porter and William A. Depyster (1783-1817) were attorneys in a partnership in New Orleans.

 

Daniel Fisher (1744-1824) was born in Deham, Massachusetts, and served as a private in Capt. Joseph Guild’s company at the Battle of Lexington. He was commissioned a captain in Col. McIntosh’s 1st Suffolk County regiment. He died in Belpre, Ohio.
