John Godfrey Legal Summons to Soldier Who Refused to Attend Training in 1748 "In his Majesty's name"

Signed by "John Godfrey" as Justice of the Peace and addressed to the Sheriff of Bristol County. Concerning a summons for a soldier who committed muster negligence. 2pp, measuring 7" x 7.75". Bristol, dated January 28, 1748. Godfrey has added an additional note on verso, which he has also signed, dated February 15. With flattened folds, light soiling and foxing throughout, and a few small tears at the lower edge. Slightly uneven edges, but no text is affected. Boldly signed.

The legal summons in part:
"In his Majesty's name you are required to summon and give notice unto Seth Chase…to answer unto Barnaby Tisdale yeoman…Seth Chase was then an inlisted [sic] soldier of a company and lyable [sic] to train in it and had been duly warned to attend and do the service of a Training Days…yet the sd Seth Chase: against ye to have neglected or refused to appear attend and do the service of sd Training Days…" On verso, Godfrey has made an additional notation, reading "Pursuant to the within written writ: I have summoned and given notice to the within named Seth Chase Deft. To appear at the same time and place to answer to Barnabus Tisdale…"

John Godfrey (1691-1758) was the song of Richard and Mary Godfrey and was appointed Justice of the Peace in 1739. Due to a fire that destroyed the town records of Taunton, any document bearing Godfrey's signature is worth a great value. Godfrey was also the father of George Godfrey, who served in the provincial militia during the French and Indian War and rose to the rank of brigadier general during the Revolutionary War. He later served as Bristol County's Justice of the Peace, Treasurer, Selectman, and Representative.

In addition, we compare our shipping and handling rates against those of other auction houses, to ensure that our charges are among the lowest in the trade.
