James Smith, Pennsylvania Declaration Signer, DS

 

1p partly printed manuscript 2x signed by Pennsylvania Declaration of Independence signer James Smith (1719-1806), first as "Smith Jun." at bottom left, and second as "Smith Jr." at bottom center verso. Recorded during the April term in 1787 in Cumberland County, Pennsylvania. Docketed and numbered verso. In very good to near fine condition, with several well-worn vertical paper folds. Overall toning and isolated foxing. The document measures 8.375" x 6.5".

 

James Smith signed this legal document from south central Pennsylvania about a decade after he represented Pennsylvania in the Continental Congress. The plaintiff Thomas Wilson sued defendant Robert Campbell for repayment of a debt of £20 plus £10 damages. Campbell had refused to repay his creditor, despite signing a contract dated June 14, 1785. John Doe and Richard Roe served as pledges of prosecution; this imaginary pair has appeared in the records of English court cases since the Middle Ages and represented the "average citizen." (Lawyers also coined another favorite duo, John Den and Richard Fen.)

 

James Smith emigrated from Ireland to the American colonies as a young boy. The lawyer later served a Pennsylvania delegate to the Continental Congress, where he signed the Declaration of Independence. (His name appears in the middle of the fourth column from the left.)
