The 40th Congress met from March 4, 1867, to March 4, 1869, and saw the impeachment of President Andrew Johnson. The primary charge against Johnson was related to his removal of Edwin Stanton, Secretary of War, from office. Johnson became the first president to be impeached when the House of Representatives adopted the articles of impeachment on March 3, 1868. He was ultimately acquitted on May 16, with a 35-19 vote in favor of conviction falling one vote short of the two-thirds majority needed. A second trial was held ten days later in an attempt to convict Johnson on additional articles, but this too failed.
