Hayes-Tilden Disputed Election Rare Mustard Yellow Ticket

Congressional hearings ticket issued after the hotly contested 1876 U.S. presidential election between Rutherford B. Hayes (1822-1893) and Samuel J. Tilden (1814-1886). Ticket no. 495 dated February 19, 1877 admitted the bearer into the Gallery of the House of Representatives, where "Counting the Vote for President and Vice-President" proceedings could be observed. On mustard yellow heavy stock, and signed in facsimile by Thomas W. Ferry, President pro tempore of the Senate, and Samuel J. Randall, Speaker of the House. Near fine. 4.75" x 3".

There was no clear winner of the presidential election held on November 7, 1876. Results from both the popular vote and the Electoral College were put into question by allegations of voter fraud and other technical anomalies.

Democratic candidate and sitting New York Governor Samuel J. Tilden had won over 50% of the popular vote, yet both he and his opponent had been accused of widespread corrupt voting practices in the election aftermath. Electoral College results were also problematic. 20 votes were in dispute because of inconsistencies like the submission of two different sets of votes, or the fact that ineligible electors had participated.

An Electoral Commission comprised of eight Republicans and seven Democrats was appointed in late January 1877 to investigate election results, and a month of congressional hearings followed. Ultimately, the contested Electoral College votes were given to Republican candidate and sitting Ohio Governor Rutherford B. Hayes as part of the Compromise of 1877. Hayes's presidency was assured in exchange for his promise to withdraw federal troops from the Reconstruction South.

Yet after losing the popular vote by 250,000, and eking out a meager Electoral College victory of 185 to 184, Hayes certainly lacked a presidential mandate.
