Historical Background

From 1969 to 1986, Warren Burger served as Chief Justice of the United States Supreme Court. A transitional court between the more liberal former court under Chief Justice Earl Warren and the subsequent more conservative court under Chief Justice William H. Rehnquist, the Burger Court continued many of the interpretations of the Warren Court.

In addition to Burger, these signatures include those of Lewis F. Powell Jr. and William H. Rehnquist, both nominated late in 1971 by President Richard Nixon.

Among the most important and controversial decisions of this court were Roe v. Wade (1973), which struck down several state restrictions on abortion; United States v. Nixon (1974), which unanimously rejected President Nixon’s claim of executive privilege over communications between the president and his advisors; Gregg v. Georgia (1976), which refused to classify the death penalty as always “cruel and unusual punishment,” prohibited by the Eighth Amendment; and Regents of the University of California v. Bakke (1976), which upheld the use of affirmative action in college admissions.
