Penn John 1740 - 1788 Declaration Signer John Penn orders the Granville County Sheriff to arrest William Dodson accused of trespass by his brother Charles.


Autograph Document Signed "J. P" on verso, one page, 7.25" x 3". Granville County, North Carolina, May 5, 1783. Lightly browned at folds. Fine condition. In full, "State of No. Carolina, To the Sherif of Granville County Greeting. We Command you to take the body of William Dodson late of your said County planter - if to be found in your bailiwick & him safely keep so that you have him before the Justices of our County Court of Granville at the Courthouse on the first monday in Aug. next to Answer Charles Dodson of a plea of trespass on the case Damage Twenty pounds Specie and have you there then this writ Witness Asa Searey Clerk of our said Court the 5th day of May A.D. 1783." Signed "Asa Searey C.C." On verso, Penn has docketed his document "Dodson vs Dodson) Writ. To Aug Term 1783" signing "J.P." Also signed on verso "Thornton Yancey," Sheriff of Granville County. Yancey had represented Granville County in the 1776 North Carolina Constitutional Convention and in the N.C. General Assembly in 1778, 1784, 1786-1787, and 1789-1792. In 1781, John Penn was elected to the N.C. Governor's Council and served as its president during the last months of the war. In 1783, he lost reelection to the council and returned to the practice of law. North Carolina records show that Charles Dodson, Sr. received 625 acres of land from Lord Earl Granville on May 11, 1756. At his death, his son William inherited the land. On August 3, 1760, William Dodson gave his brother, Charles Dodson, Jr., 200 acres of the land (Granville Co. Deed Records Book H, Page 446). Their widowed mother, Frances, would live on the land and would have use of the house, woods, and timber for the rest of her life and then revert to Charles. Frances was still alive in 1783 when Charles accused his brother of trespass.
