Daniel Dulany, Stamp Act Opposer, Rare Lengthy ADS Written 1 Year After Act's Repeal

A legal opinion written by Daniel Dulany and signed twice at the conclusion. 4pp of a bifolium, measuring 7.5" x 12.5", n.p., dated March 6, 1767. The opinion has flattened folds, with tears, chipping, and separations at the folds, spine, and edges. Light toning at the edges. Minor soiling and foxing throughout as well as some contemporary ink smudges. Boldly signed by Dulany, very good.

Dulany writes his opinion on a land dispute, stating it is his belief "that A. will not be able to maintain a Title, under the Grant of Clark's Inheritance, to any Part of the Land…" He goes on to outline his legal thinking process and offers more opinions on the case. Signed at the conclusion "Danl. Dulany" and after a short postscript, "DD." 

In part:
"…The Determinations of Arbitrators have not a legal force to transfer a Freehold; but such a Determination & an Acquiescence under it, for 40 years, wou'd probably have great weight with a Jury upon a Contest at Law…I am much inclined to be of opinion, that the Possession will prove a Bar to A.'s Claim…My opinion with the Grounds of it have been explained; But I think it necessary to intimate that, having respect to what may be the Decision of a Jury, I desire to be understood, as speaking with some Difference. If the Dispute depended merely upon a Point of Law, I cou'd undertake to speak more positively, then I can venture to do, when it depends upon a Point of Fact, &, especially of Bounds…"

Daniel Dulany (1722-1797) was a Maryland lawyer and influential political figure prior to the American Revolution. He became a member of the Maryland legislative assembly in 1751 and served until 1754, after which he was appointed to the Governor's Council. In the following years, he continued his law practice and became one of the best, most-respected lawyers in the colonies. Although Dulany remained loyal to the British crown, he was critical of several policies enacted by the British government, most notably - the Stamp Act of 1765. At the height of the crisis over the Stamp Act, he wrote a pamphlet entitled, "Considerations on the Propriety of Imposing Taxes in the British Colonies", which became one of the most influential publications in opposition to the Act. The Stamp Act was finally repealed on March 18, 1766, just one year prior to this document's signing. Ultimately, though, Dulany remained a Loyalist and his substantial property was confiscated by the American government in 1781.
