Description:

Account of the 1st Session of the US Supreme Court in "Gazette of the United States"

4pp of a bifolium, measuring 10.25" x 17.75", [New York], dated February 3, 1790. An issue of the "Gazette of the United States", No. LXXXV, containing an account of the first session of the United States Supreme Court. John Jay presided over the proceedings as Chief Justice, and it was noted that "The Court Room at the Exchange was uncommonly crouded [sic]. - The Chief Justice and other Judges of the Supreme Court of this State; the Federal Judge for the district of New York; the Mayor and Recorder of New-York; the Marshal of the District of New-York; the Sheriff and many other officers, and a great number of the gentlemen of the bar attended on the occasion…" The paper has been signed at the top margin of the front page, "Stepn Hall", with additional pencil notations in another hand. The paper has flattened folds, uneven edges, and a few small tears and separations at the folds and edges. Minor chipping at edges in places. Light toning, foxing, and soiling throughout. A small area of insect damage. Overall, very good.

The United States Supreme Court was established by Article Three of the U.S. Constitution, which took effect in March 1789 and granted the Court ultimate jurisdiction over all laws, especially those in which constitutionality was debated.
The first session was held in New York City's Royal Exchange Building on February 1, 1790, with only four of the six appointed justices attending; John Rutledge had decided not to attend the meeting and Robert Harrison was too ill to travel. Those that were in attendance were John Jay, James Wilson, William Cushing, and John Blair Jr.
