1874 Waco, Texas Handwritten Court Docket, Fantastic Content

A large volume, measuring 8.5" x 14", Waco, Texas, dated January 20, 1874 to December 29, 1874. The city of Waco's bound court docket, recording the year's arrests. 357 pages have been used of the total 433 pages. Each recorded crime lists the date, offender's name, charge, fine, and a summary of the suit and result. Each is also witnessed and signed by Mayor Jacob Long. The range of crimes committed is substantial, including: being drunk, using obscene and profane language, indecent exposure in public, assault and battery, disturbing the peace, fighting, assault with a knife, gaming and gambling "suffering a monte bank", fast riding, exhibiting a theatrical performance without a license, discharging fire arms within the city, selling liquor on a Sunday, selling meat without a license, carrying a pistol, leaving an animal unattended, riding a horse on the sidewalk, stabbing, and careless driving. Fines generally ranged between $1.00 to 10.00, although some went as high as $25.00. There are also a few cases where the Defendant was only charged $0.01, although it is unclear whether this was because the charged individual was a minor, or if it was done as a warning or a special favor. Examples of Court Cases:

Pg. 38: March 19, 1874. Sallie Raffell is charged with "Disturbing the Peace by using profane & offensive language…Enters her plea of Not Guilty. The Court after hearing all the evidence in the case believes that the Defendant is Not Guilty as charged. It is therefore considered by the Court that the Defendant go home without delay and the City of Waco takes nothing by her suit."

Pg. 210: August 15, 1874. Francis Freeman is charged with "betting at Monte…Now comes the City by attorney and the Defendant in Person & Enters his Plea of Not Guilty. The court after Hearing all the Evidence in the case believed the Deft Guilty as charged. It is therefore considered by the Court that the City of Waco have a judgement against the Deft Francis Freeman for the Sum of Twenty five dollars as a fine & for all Costs of suit, & he be committed to work on the streets until said fine & costs are paid. Therefore the Deft gave notice of an appeal to the next Term of the Hon Criminal Court of the City of Waco, which was granted."

The volume has chipping, edgewear and rubbing, and bumping to the cover and spine. With toning, ink spots, and soiling to the cover as well. Light foxing to the first few internal pages. Cocked binding and a few loose pages. Edge toning to the internal pages, else clean and very good.

Jacob Long (1811-1878) was a native of North Carolina and served as a district judge and city recorder of Waco becoming Mayor. He served as mayor from 1872-1874.

International shipments: In order to comply with our insurance provider, all international shipments will be sent via Fed Ex and customs paperwork will show a value of $1.00. International buyers should contact our office directly with any questions regarding this policy.
