An 1846 clerical copy of emancipation papers, filed in King George Superior Court in Virginia. 2pp, measuring 7.5" x 12.25", King George County, Virginia, dated November 20, 1846. The original document was dated November 4, 1846. The legal document is broken into two sections, with one detailing the wishes of Elizabeth Carter, deceased, to emancipate her slaves, and the second being a statement of the Executrix of her estate. The document has been signed at the conclusion by William Brown, Clerk of the Court. With flattened folds and light toning. Overall very good.

In part:
"I have ever been desirous to emancipate the following slaves in whom I have a fee simple, to wit; my true and faithful servant Betty, the gift of my dear father, and here let me earnestly recommend her to the care of all my beloved children, when I am no more to whom also she has even been a most sincere friend. Jack, Winney his wife and their three daughters, Rebecca, Nelly and Esther with their three children, Hugh, Watt and Tom, and knowing these servants will not be willing to leave this estate, the three first being old and infirm, and hoping they will not be forced from their native state on account of their faithful services: I make the following provision for them; I give and bequeath to Betty, Jack and Winney his wife during their lives ten acres of land I purchased of Mrs. Mildred Ann B. Lewis, with the house that is upon it, formerly her dwelling house, with the privilege of getting as much wood as will serve them for fuel and to enclose their land. I also permit their three daughters, Rebecca, Nelly & Esther to live with them, also any children they may have, till their death, that they may work for them, and I trust that they will be dutiful children & take care of their aunt in her old age, also of their poor infirm parents, at their death, that is the three first, the ten acres of land, with the house is to revert to my daughter Eliza T. Macfarlane, to whose control it is to be held subject in all things, and on no account to be transferred by them to any one else, and I earnestly request the favor of my dear daughter, to stand mistress for them, during the lives of the three oldest, and to render them every service in her power, to wit, Betty, Jack & Winney and I hereby do emancipate them…

…Know all men by these presents that I, Eliza T. Macfarlane Executrix of the last Will and testament of Elizabeth Carter deceased late of the County of King George and whose last Will & testament is duly recorded in said County, do hereby declare that negroes, Nelly, Dayne & are the same negroes mentioned & referred to in the Will of the said Elizabeth Carter deceased, or those born since her death, & are therefore entitled to enjoy & have their liberty as free and emancipated slaves. And I the said Eliza T. Macfarlane acting under the directions of the said Will do hereby further declare that they, the adults among said slaves have my permission to obtain the evidence of their freedom from the Clerk of the County Court of King George, at any expense… And I do hereby further consent & agree that the infants herein before mentioned may also go with their parents & when they shall severally attain the evidence of their freedom from the Clerk as aforesaid….

We insure through Berkley Asset Protection with rates of $.70 per $100 of value, among the lowest insurance rates in the industry. Our shipping department cameras document every package, both outgoing and incoming, for maximum security. In addition, we compare our shipping and handling rates against those of other auction houses, to ensure that our charges are among the lowest in the trade.

Upon winning your item(s), you will receive an invoice with our in-house shipping and handling fees included. ***We will ship to the address as it appears on your invoice. If any changes to the shipping address need to be made, you must inform us immediately.***

International shipments: In order to comply with our insurance provider, all international shipments will be sent via Fed Ex and customs paperwork will show a value of $1.00. International buyers should contact our office directly with any questions regarding this policy.

Third Party Shipping Option: If a third party shipper is preferred, the buyer is responsible for contacting them directly to make shipping arrangements. For your convenience, we have provided some recommended shippers. For your protection, we will require a signed release from you, confirming your authorization for us to release your lots to your specified third party. At that point, our responsibility and insurance coverage for your item(s) ceases. Items picked up by third party shippers are required to pay Connecticut sales tax. Items requiring third party shipping due to being oversized, fragile or bulky will be denoted in the item description.
